An American Coup D'Etat - Lawfare in the 21st Century
This week saw the Biden-appointed US Special Prosecutor Jack Smith move to dismiss two federal cases that he filed against President-Elect Donald Trump. Because Smith serves not the "Rule of Law," but a craven obedience to power. His deliberate attempt to influence a federal election with government power and money had failed.
The Smith cases were part of a matrix of thousands of legal actions - criminal and civil - filed by Biden and his allies, designed to disable and cripple Trump and his supporters in the run-up to the 2024 election. To use government power and money to influence the outcome of a federal election.
The Rule of Law demands that law - the rules - must be applied equally. Not created, selectively enforced, and contorted to target political opponents. The alternative to the Rule of Law is the Law of the Jungle: Corruption, Brutality; Caprice; Injustice; the end of a normal society.
Had a group of armed soldiers used their guns and brute force to arrest Trump (or Biden) and his supporters it would be called a "Coup." The corruption and abuse of the law enforcement power to target and arrest political opponents is even worse - because it destroys faith and the integrity of the police and Courts - something that takes generations to rebuild.
Manhattan DA Alvin Bragg went the farthest - indicting Trump on 34 felony counts of "falsifying business records" and running a farcical trial that resulted in a conviction on all counts. Except Bragg's "theory" was nonsense: There was no "falsification" because Trump's payment of a non-disclosure agreement (NDA) - for a non-campaign worker - was a valid "Business" expense and NOT a "Campaign" expense. That is black letter law from the US Federal Elections Commission (FEC).
Bragg's "theory" was the opposite of settled law - and sought to criminalize proper and legal business conduct. That is why Bragg and Democrat Judge Juan Merchan barred testimony from the Chairman of the FEC, who would have exposed their nonsense. But Bragg and Merchan were happy to use Gag orders; Contempt filings; mandatory personal appearances; and a trial schedule designed to directly interfere with the US election.
And there were thousands of other cases - criminal and civil - designed to cripple, bankrupt, disbar, jail, and gag Republican supporters of Trump.
The corruption of law enforcement and the Courts to wage war on political opponents is called "Lawfare." And it is illegal.
If the Lawfare of the past four years goes unpunished - it will happen again. If a "Dirty Cop" rapes women, or steals money, or - like former Suffolk Police Chief James Burke - beats handcuffed prisoners and orders cops to lie - it must be punished.
Those who abuse government power for their own personal corruption and benefit are the worst of all. People who waged Lawfare should be charged under the law for their crimes. And no one should flinch from protecting the integrity of the Rule of Law.
